Oregon Tote Rentals - Rental Agreement, Terms & Conditions Please read these terms carefully as these Terms and Conditions (“Rental Agreement”) set forth the entire understanding between Oregon Tote Rentals LLC, an Oregon limited liability company and you, the customer with respect to the rental of Equipment (as hereinafter defined). You agree with, and agree to be bound by, this Rental Agreement. Furthermore, you agree that all information you provide Oregon Tote Rentals, LLC is accurate, correct, and up to date. SOME DEFINITIONS 1) “Renter”, “You”, “Your”, and the like, refers to you, the person purchasing, using, and/or accessing our services. 2) “Oregon Tote Rentals, LLC”, “Oregon Tote”, “We”, “Us”, and the like, refers to Oregon Tote Rentals, LLC, and/or its employees, representatives, agents, or others for whom we are at law responsible. 3) “Services” refers to any and all services, products and/or other offerings on our website, including, but not limited to the renting, delivery and pick up of the equipment. 4) “Equipment” means any and all equipment rented to you, including but not limited to the totes. OVERVIEW OF SERVICES After you purchase any of our services, Oregon Tote Rentals, LLC will rent the equipment to you for the selected rental period. At the beginning of the rental period, Oregon Tote Rentals, LLC will deliver the equipment and/or any purchased items to your delivery address and at the end of the rental period, we will pick up the rented equipment from your pick up address. We do NOT assist with packing or moving. EQUIPMENT CONDITION Oregon Tote Rentals, LLC warrants that the equipment rented and/or materials purchased under this Rental Agreement will be in good working order on the effective date of the Rental Agreement. Equipment supplied and maintained subject to this warranty. Oregon Tote Rentals, LLC ’ sole obligation under this Rental Agreement is limited to repairs or replacement of the equipment when the customer determines that it does not conform to this warranty. RENTAL PERIOD The rental period for tote rental packages (totes and tote dollies) is (1) week, (2) weeks, (3) weeks, or (4) weeks. Each week is a standard (7) day calendar week. The rental period for all other rental equipment (hand trucks, furniture dollies, additional tote dollies, moving blankets, padded glassware totes, laundry bags, linen bags, etc.) is the duration of your tote package rental period up to (4) weeks. If you keep the tote rental package equipment longer than your original rental period, you will be billed the difference between your original rental period and the next longer rental period, up to 4 weeks. After 4 weeks, you will be billed the standard (1) week rental fee each week based on your selected package. Other rental equipment will be billed the standard fee each week. If equipment has not been returned within 30 days following your original rental period, and you have not communicated and arranged an extended rental, it will be assumed that you wish to purchase the equipment, and you will be charged the full retail replacement value of the equipment: Totes = $35 each Tote Dollies = $80 each Hand Trucks = $200 each Furniture Dollies = $50 each Moving Blankets = $20 each Laundry Bags = $10 each Padded Glassware Totes = $30 each Linen Bags = $10 each ·CANCELLATION POLICY A full refund is provided if you cancel your order at least 48 hours before your scheduled delivery time window starts. Orders cancelled in less than that time will incur the lesser of a 50% cancellation fee or $100. DELIVERY AND PICK UP CHARGES Delivery and pick up is free within our service area when purchasing a tote rental package. Additional fees will be required for delivery and pick up outside of our service area. This fee will be calculated, communicated, and approved by you before being charged as part of the Rental Agreement. If other equipment is rented and/or materials purchased without a totes rental package, separate $25 delivery and pick up fees will be charged. EQUIPMENT DELIVERY & RETURN A responsible person aged 18 years or older must be present at delivery and pick up of the equipment. This person needs to verify along with us the items, quantities, and acceptable condition of the equipment. Depending on how the rental was processed, this same person may be required to sign documents and/or make a payment for the Rental period at the time of delivery and/or pickup. If you are not home for a scheduled delivery or pick up, you will be charged $30 for each instance. Delivery and pick up date and time window will be coordinated between you and Oregon Tote Rentals, LLC at least 24-hours prior to the event. You grant Oregon Tote Rentals, LLC the right to enter the property at the delivery and pick up addresses when delivering or picking up equipment. You will only release the equipment to a Oregon Tote Rentals, LLC employee. Oregon Tote Rentals, LLC cannot deliver or pick up where climbing more than a single flight of stairs is required. In these cases, Oregon Tote Rentals, LLC can deliver to the ground floor lobby or location convenient to Oregon Tote Rentals, LLC and the customer; so long as this location is safe and non-obstructing to traffic whether it be foot traffic or vehicular traffic of any kind. OPERATION OF EQUIPMENT You agree to use the equipment in a safe manner and at your own risk. You will not use the equipment to store, transport, carry, or otherwise make contact with any hazardous or corrosive materials, unsealed liquids, or any other substances or materials to include illegal substances that will damage the equipment or make it unusable for future rentals. You will never use the equipment to house or transport children or animals. You will not allow children of any age to operate or play in or around the equipment at any time. POSSESSION & CARE OF EQUIPMENT You agree to keep the rented equipment in your custody and care and not to sublease, rent, lend, or sell the equipment. The equipment will be in your possession but will remain the sole and exclusive property of Oregon Tote Rentals, LLC throughout the rental period. No alteration to the equipment is to be made. DAMAGED OR LOST EQUPMENT You accept full responsibility for all loss or damage to equipment while it is in your possession. Equipment that is damaged while in your possession and care or not returned will be billed at the full retail replacement value for each item. See the RENTAL PERIOD section regarding retail replacement costs. PAYMENT TERMS To complete the purchase of a rental order or materials purchase, payment will be made on Oregon-Tote-Rentals.com (“our Website”) during the checkout process. Initial payment will be made for the package and rental period, any other rental equipment, and any materials chosen and agreed upon during checkout. All applicable sales/rental taxes will be paid at that time. In some occasions Oregon Tote Rentals, LLC will allow for the customer to pay upon delivery when circumstances arise that warrant that action. CREDIT CARD AUTHORIZATION Oregon Tote Rentals, LLC will keep your credit card on file for the duration of the rental agreement and at least (1) week thereafter. You authorize Oregon Tote Rentals, LLC to charge any amounts permitted or authorized by this Rental Agreement. PRIVACY Oregon Tote Rentals, LLC will not sell or share your personal information for any reason unless collections for unpaid services is required or if required by law. SMS PRIVACY POLICY Oregon Tote Rentals, LLC may disclose Personal Data and other information as follows: Third Parties that Help Provide the Messaging Service: We will not share your opt-in to an SMS short code campaign with a third party for purposes unrelated to supporting you in connection with that campaign. We may share your Personal Data with third parties that help us provide the messaging service, including, but not limited to, platform providers, phone companies, and other vendors who assist us in the delivery of text messages. Additional Disclosures: Affiliates: We may disclose the Personal Data to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your Personal Data will be subject to this Policy. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. INDEMNIFICATION I, the customer agree to Indemnify and hold Oregon Tote Rentals, LLC, its officers, agents, and employees, harmless from and against all liabilities, claims, actions, proceedings, damages, losses, cost and expense, including attorney’s fees, for all injuries or death of any person or animal, or damage to any property occurring or arising from or connected with directly or indirectly, my possession, use and return of any of the products or equipment. The customer shall be in charge of the equipment operation and is fully responsible for its operation as well as the return of the equipment in good working order. Oregon Tote Rentals, LLC and its officers, employees, and agents are not responsible for any injury occurring to the customer or to any other persons or animals using the products or equipment, and the customer further agrees to hold Oregon Tote Rentals, LLC and its officers, employees, and agents harmless against any injury or property claims. The customer shall indemnify Oregon Tote Rentals, LLC and its officers, employees, and agents from/against any costs incurred due to claims from anyone and for attorney’s fees and related costs involving the use and return of the equipment, should any legal action become necessary. AND FINALLY Oregon Tote Rentals, LLC reserves the right to add, change or modify this Rental Agreement at any time without notice. All agreements signed previous to any changes will be honored as written and agreed upon.
